Terms of Service
Last updated: 2026-10-24
These Terms of Service ("Terms") are a binding agreement between you and the individual who owns and operates SayItBest.org and SayItSmart.org (together with that individual, "SayItBest", "we", "us"), and they govern your use of those sites and the rewriting service (the "Service"). By using the Service in any way, including by clicking "Make It Better", you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Please read Section 12 carefully. It requires you to resolve disputes with us through individual binding arbitration and waives your right to a jury trial and to participate in a class action.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to use the Service. If you use the Service on behalf of a business or other organization, you confirm that you are authorized to accept these Terms for it, and "you" includes that organization.
2. What the Service is
SayItBest uses an automated artificial-intelligence model to suggest rewritten versions of text you provide in a tone you choose. The Service is a writing aid only. Suggestions ("Output") are generated automatically, without human review, and may be inaccurate, incomplete, inappropriate, offensive, or may change the meaning, facts, tone, or legal effect of what you wrote. Output may be similar or identical to output given to other users.
3. No professional advice
The Service does not provide, and Output is not, legal, financial, tax, medical, psychological, employment, human-resources, or any other professional advice. Nothing on the Service creates an attorney-client, fiduciary, or other professional relationship. If your message has legal, financial, business, employment, medical, safety, or other important consequences, consult a qualified professional before sending it.
4. You are responsible for what you send
You decide whether and how to use any Output. You are solely responsible for reviewing, editing, and verifying Output before you use it, and for all consequences of sending, publishing, or relying on it, including any effect on your relationships, employment, business, contracts, disputes, negotiations, or legal position. You assume all risk arising from your use of Output. You also confirm that you have the right to submit any text you enter and that submitting it does not violate any law, contract, or anyone else's rights.
5. Acceptable use
You agree not to use the Service to: harass, threaten, defame, or harm anyone; commit or assist fraud, phishing, impersonation, or any illegal activity; create spam or deceptive content; infringe intellectual-property or privacy rights; submit other people's sensitive personal information without permission; interfere with, overload, scrape, reverse-engineer, or bypass the limits or security of the Service; or access it by automated means. We may limit, suspend, or block any use at any time, with or without notice.
6. Your content and our rights
You keep whatever rights you have in the text you submit. You give us a limited permission to process that text solely to provide the Service to you. As described in our Privacy Policy, we do not store your text after producing your result. To the extent we have any rights in Output, we assign them to you, subject to these Terms. The Service itself, including its software, design, and branding, belongs to us and is protected by law.
7. Free service; changes
The Service is provided free of charge, with usage limits that may change. We may change, suspend, or discontinue any part of the Service, or these Terms, at any time. If we change these Terms, we will update the date above; your continued use after a change means you accept the updated Terms.
8. Third parties
Optional voice dictation is provided by your web browser or device, not by us, and is governed by that provider's terms. The Service may display advertising or link to third-party sites; we are not responsible for third-party content, products, or services.
9. Disclaimer of warranties
THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE, APPROPRIATE, LAWFUL, OR SUITABLE FOR ANY PURPOSE OR ACHIEVE ANY RESULT.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SAYITBEST, OR ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, OR SUPPLIERS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, CONTRACTS, GOODWILL, EMPLOYMENT, OR DATA, OR FOR REPUTATIONAL HARM OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATING TO THE SERVICE, ANY OUTPUT, OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED FIFTY U.S. DOLLARS (US$50). THESE LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND ARE A FUNDAMENTAL PART OF THE BASIS OF THE BARGAIN BETWEEN YOU AND US; WITHOUT THEM WE WOULD NOT PROVIDE THE SERVICE FOR FREE.
Some jurisdictions do not allow certain exclusions or limitations; in those places they apply to the maximum extent the law allows.
11. Indemnity and release
You agree to defend, indemnify, and hold harmless SayItBest and its owners, affiliates, employees, and contractors from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your use of or reliance on any Output, any text you submit, or your violation of these Terms or of any law or third-party right. To the fullest extent permitted by law, you release us from all claims arising from your use of Output or from disputes between you and any third party. If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any similar law in any other jurisdiction.
12. Disputes: informal resolution, binding individual arbitration, and class-action waiver
Informal resolution first. Before starting any formal proceeding, you agree to email us at info@designbreeze.io with a description of your claim and to try in good faith to resolve it for at least 60 days.
Arbitration. Except as stated below, any dispute, claim, or controversy arising out of or relating to the Service, any Output, or these Terms (including their formation, scope, or enforceability) will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator. The Federal Arbitration Act governs this Section. The arbitrator may award relief only on an individual basis and only to the extent needed to resolve your individual claim. Judgment on the award may be entered in any court with jurisdiction.
Class-action and jury-trial waiver. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR ARBITRATION. If this waiver is found unenforceable for a claim, that claim must be severed and decided in court, and the rest of this Section still applies.
Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek an injunction in court to stop infringement or misuse of intellectual property or the Service.
Opt-out. You may opt out of arbitration within 30 days after you first use the Service by emailing info@designbreeze.io with your name and the statement that you opt out of arbitration.
Time limit. To the extent permitted by law, any claim relating to the Service must be filed within one (1) year after it arises, or it is permanently barred.
13. Governing law and venue
These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules. For any matter not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in Texas.
14. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them without restriction. We are not liable for delays or failures caused by events beyond our reasonable control. Sections 3, 4, 6, and 9 through 14 survive any termination of your use.
